8th Amendment to the Nationality Law, effective from July 6

The main changes are:

  • Individuals born in Portuguese territory, children of foreigners, are considered Portuguese of origin since, at the time of birth, one of the parents was legally resident in Portugal for 2 years, eliminating the requirement of 5 years.
  • The naturalization of foreign citizens (through Residence Permit or Residence Card) becomes possible after 5 years of legal residence in Portugal, instead of the 6 years previously required.
  • In cases of acquisition of Portuguese nationality by virtue of marriage or civil union, there is no longer the possibility of opposition to the acquisition of nationality due to the lack of effective connection to the national community when there are common children of the couple with Portuguese nationality.
